Terms of Service

1. Agreement
These terms govern your use of the HappyPetz website and service. The service is operated by HappyPetz ("we", "us"), a business owned by Anna Yona, a licensed sole proprietor in Israel.
By creating an account or using the service, you agree to these terms. If you don't agree, please don't use the service.
2. HappyPetz is not an emergency service
Please read this section carefully. It is the most important part of these terms.
HappyPetz is an aid to help you keep an eye on your tortoise. It is not an emergency service, a guarantee of safety, or a substitute for checking on your animal yourself.
Specifically:
- Detection is not 100% accurate. HappyPetz uses AI to analyse images. It may fail to detect a flip, and it may report a flip that did not happen.
- Alerts may be delayed or may not arrive. Delivery depends on your camera, your internet connection, your power supply, email and messaging providers, and our own systems — any of which can fail.
- We do not monitor your tortoise on your behalf. No person at HappyPetz is watching. Nobody will be dispatched. We do not contact vets or emergency services.
- We make no representation that using HappyPetz will improve your tortoise's safety or health.
HappyPetz is intended only to assist you in keeping an eye on your tortoise. It is not intended to replace you as its keeper. You remain responsible for its health and welfare.
Treat HappyPetz as an additional layer of awareness, alongside — never instead of — a well-designed enclosure and your own regular checks. Never use HappyPetz to replace good husbandry, common sense, or appropriate veterinary care.
The service may also be interrupted or become unavailable. If that happens, you may need to rely entirely on your own observations and care of your tortoise.
3. Eligibility
By using HappyPetz, you confirm that you are at least 18 years old.
4. What the service does
HappyPetz receives images from a camera you set up, analyses them using AI to identify whether your tortoise appears to be on its back, and sends you an alert when it believes one has occurred.
Your camera is not part of the service. You buy your own camera from a retailer of your choice. We may suggest models we have tested, but:
- We do not sell cameras and accept no responsibility for them
- We are not responsible for camera purchases, hardware faults, warranty, or manufacturer support
- Compatibility may change if a manufacturer alters its firmware or product line
- Where we link to a retailer, we may receive a commission
5. Your responsibilities
To use HappyPetz you need to:
- Set up and maintain a compatible camera, positioned so your tortoise's enclosure is visible
- Keep the camera powered and connected
- Provide accurate contact details and keep them current
- Make sure alerts can actually reach you
- Continue to provide proper care for your tortoise, including a suitable enclosure
We are not responsible for missed detections caused by a camera being disconnected, moved, obscured, badly positioned, or otherwise not working.
6. Pricing and free access
Some or all HappyPetz features may be offered free of charge for a limited period. Current pricing, free periods and trial terms are shown on our website.
We do not ask for payment details to join.
We will notify you in advance before we begin charging an existing account beyond any free period stated when you signed up.
Paid plans, when introduced, will be billed through our payment provider under their own terms.
7. Your content
You keep ownership of the images and video your camera uploads.
By using HappyPetz, you grant us a licence to store, process and analyse that content in order to provide the service, and to use it — in de-identified form — to improve our detection models and to develop other products and services. This licence continues for de-identified content after your account is closed.
If you would prefer your content not to be used this way, contact us at privacy@happypetz.ai. Note that removing your content entirely may mean we can no longer provide the service to you.

8. Acceptable use
Don't use HappyPetz to:
- Monitor people, or any space where someone has a reasonable expectation of privacy
- Break any law
- Interfere with the service, attempt to gain unauthorised access, or place unreasonable load on our systems
- Resell or redistribute the service without our agreement
We may suspend or close accounts that breach these terms.
9. Availability
We aim to keep HappyPetz running, but we do not guarantee uninterrupted service. We may need to take it offline for maintenance, updates or repairs, and outages may happen without warning.
We may change, suspend or discontinue features. If we discontinue the service entirely, we will give you reasonable notice.
10. Limitation of liability
To the fullest extent permitted by law:
- HappyPetz is provided "as is", without warranties of any kind
- We are not liable for any injury, illness or death of an animal, or for any indirect, incidental or consequential loss arising from your use of, or inability to use, the service
- We are not liable for failures caused by your camera, your network, your power supply, or third-party providers
- We are not liable for harm occurring while the service is functioning as intended
- Where liability cannot be excluded, our total liability is limited to the amount you have paid us in the twelve months before the claim
Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Closing your account
You can delete your account at any time from your account settings. Deletion is handled as set out in our Privacy Policy.
We may suspend or close your account if you breach these terms, or if we discontinue the service.
12. Changes to these terms
We may update these terms. If we make a significant change we will notify you by email or through the service. Continuing to use HappyPetz after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Israel, and any dispute will be subject to the exclusive jurisdiction of its courts.
14. Security
If you believe you have found a security vulnerability, please report it to security@happypetz.ai rather than disclosing it publicly. We'll acknowledge your report and investigate. We don't currently run a bug bounty programme.
